Terms of Service

Effective Date: April 1, 2026

These Terms of Service ("Terms") govern your access to and use of ShelfMatch, a book recommendation service operated by Literary Reserve LLC ("we," "us," or "our"). By accessing or using ShelfMatch (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement to Terms

By creating an account or continuing to use ShelfMatch, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use ShelfMatch. By creating an account, you represent that you meet this age requirement. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@literaryreserve.com if you suspect unauthorized access to your account.

3. Service Description

ShelfMatch provides curated book recommendations matched to your reading preferences. The Service is available in two tiers:

• Free Tier: Up to 5 personalized book recommendations per week, access to your reading library, and basic taste profile features.
• Premium Tier ($2.99/month): Unlimited recommendations, advanced filtering, priority access to new features, and expanded library management tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

4. Acceptable Use

You agree not to:

• Use automated tools, bots, scrapers, or crawlers to access or extract data from the Service.
• Send spam, unsolicited messages, or harass other users.
• Engage in fraudulent activity, including creating multiple accounts to circumvent usage limits.
• Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

Violation of these rules may result in immediate suspension or termination of your account.

5. Intellectual Property

• ShelfMatch Ownership: The ShelfMatch name, logo, user interface, design, source code, matching technology, and all related intellectual property are owned by Literary Reserve LLC. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
• Your Content: You retain ownership of your ratings, reviews, library data, and any other content you create within ShelfMatch. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of providing and improving the Service.
• Under The Radar Books Content: Book reviews, editorial content, and curated lists published under the Under The Radar Books brand are owned by Literary Reserve LLC and may not be reproduced without permission.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. BOOK RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES AND DO NOT CONSTITUTE PROFESSIONAL ADVICE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITERARY RESERVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Premium Subscription

• Billing: Premium subscriptions are billed monthly at $2.99/month through Stripe. Your subscription automatically renews each month unless you cancel before the renewal date.
• Cancellation: You may cancel your Premium subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain Premium access until that date.
• Refunds: Subscription payments are non-refundable. No partial refunds will be issued for unused portions of a billing period.

9. Affiliate Disclosure

ShelfMatch earns a commission from purchases made through Bookshop.org affiliate links at no extra cost to you. When you click a "Buy" or "Shop" link within ShelfMatch, you may be directed to Bookshop.org, where your purchase supports independent bookstores. Affiliate relationships do not influence which books are recommended to you.

10. Account Termination

• By You: You may delete your account at any time through your account settings. Upon deletion, your personal data will be anonymized or removed within 30 days in accordance with our Privacy Policy.
• By Us: We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if continued access poses a risk to the Service or other users. We will make reasonable efforts to notify you before termination, except in cases of severe violations.

11. Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising from or related to these Terms or the Service shall be resolved as follows:

• Informal Resolution: Before filing any formal claim, you agree to contact us at hello@literaryreserve.com and attempt to resolve the dispute informally for at least 30 days.
• Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered in San Francisco County, California, under the rules of the American Arbitration Association. Each party shall bear its own costs.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
